NEXTBIGWIN PRO — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your purchase and use of the NextBigWin Pro subscription (“NBW Pro,” “the Service,” “we,” “us,” or “our”). By purchasing, accessing, or using NBW Pro, you agree to be bound by these Terms.

1. Definitions

Subscriber: The individual or entity purchasing the Service.
Service: The NBW Pro subscription, including all content, insights, tools, coaching, and introductions.
Annual Subscriber: A Subscriber who purchases the annual plan.
Guaranteed Introduction: One curated, double-opt-in introduction provided to Annual Subscribers under the conditions in Section 5.1.
ICP: The Ideal Client Profile and buyer persona agreed upon during onboarding.
Comparable Substitute: A replacement introduction that may vary in title, seniority, or company size if the original contact becomes unavailable.

2. Subscription Plans & Pricing
2.1. Founding Member Pricing

Founding Member pricing is available at launch:

  • Monthly: $250/month
  • Annual: $2,500/year
2.2. Price Lock
Founding Member pricing is locked for 24 months from the purchase date. After 24 months, pricing may increase at our discretion.
2.3. Cancellation & Loss of Founding Rate

If the Subscriber cancels or allows the subscription to lapse due to failed payment:

  • The Founding Member rate is permanently forfeited.
  • Returning Subscribers must pay the then-current public price.
    No exceptions.
3. Billing, Renewals & Refunds
3.1. Early Charge to Secure Rate
You are charged immediately at checkout to secure the Founding Member rate.
Your active billing cycle begins January 12, 2026.
3.2. Auto-Renewal

All plans renew automatically:

  • Monthly: every 30 days
  • Annual: every 12 months
3.3. Cancellation
You may cancel at any time. You retain access until the end of your current billing period.
3.4. Refund Policy
ALL PAYMENTS ARE NON-REFUNDABLE, INCLUDING PARTIAL PERIODS, REGARDLESS OF USAGE, SATISFACTION, OR ACCESS ISSUES.
Annual subscriptions are fully prepaid and non-refundable.
This refund policy does not limit any non-waivable legal rights you may have under applicable law.
3.5. Failed Payments
If payment fails, we may:

  • Allow a brief grace period
  • Pause or terminate access
  • Permanently remove Founding Member pricing

  • Premium Agency Listing
  • Weekly Email Briefings
  • Real-Time Web Updates on TheNextBigWin.com
5. Additional Benefits for Annual Subscribers
5.1. Guaranteed Introduction

Annual Subscribers receive one included double-opt-in introduction per annual term, subject to the following conditions.

NBW Pro is the sole and final decision-maker regarding what qualifies as:
  • A reasonable target
  • An aligned match
  • A Comparable Substitute
  • A fulfilled introduction

Eligibility Requirements

A Guaranteed Introduction must:

  • Align with the ICP and buyer persona
  • Be reasonable in scope
  • Fit the Subscriber’s service category
  • Not pose reputational or relationship risk

Requests such as “Fortune 10 CMOs only” are not reasonable.

Timing

The introduction may occur at any point during the annual term and may extend beyond 12 months when:

  • Prospects are unavailable
  • Responses are delayed
  • No aligned match exists
  • Market conditions require additional lead time

Timing is not guaranteed.

When the Introduction Is Considered Fulfilled A Guaranteed Introduction is fulfilled when:
  • We provide a double-opt-in introduction aligned with the ICP, or
  • The Subscriber declines a qualified introduction, or
  • The Subscriber delays or obstructs scheduling, or
  • The original contact becomes unavailable and a Comparable Substitute is provided

Meeting outcomes are not guaranteed.

Business Outcome Disclaimer

The Guaranteed Introduction does not guarantee revenue, opportunities, proposals, follow-up meetings, or business results.

5.2. Strategic Coaching

Annual Subscribers receive:

  • One quarterly 1:1 strategy call
  • Priority guidance
  • 50% off The Relationship Making Blueprint group program

Strategic coaching is informational only and does not constitute legal, financial, hiring, or professional advice.

6. License & Use of Content
6.1. Single-User License

Your subscription provides access for one individual user only. You may not:

  • Share login credentials
  • Share content internally or externally
  • Store content in internal systems
  • Upload NBW Pro content into AI systems
  • Use NBW Pro content to train or fine-tune any AI or ML model
  • Scrape, extract, or automate data collection

We may audit access, including reviewing login patterns, IP addresses, device usage, and account behavior.

6.2. Non-Transferability
Subscriptions may not be sold, assigned, or transferred without written consent.
6.3. External Redistribution
You may not forward, repost, publish, repurpose, resell, or externally distribute NBW Pro content.
6.4. Ownership
We retain full ownership of all content, data, insights, research, tools, and intellectual property.
7. Support & Reasonable Use

Support is provided via email at christian@christianbanach.com.
We do not guarantee phone support or response times.

Support and coaching must be used reasonably. Excessive or abusive requests may result in reduced access, rescheduling, or termination.
8. Termination

We may terminate your subscription immediately and without refund for:

  • Aggressive, unethical, or inappropriate behavior
  • Harassment of CMOs, partners, or NBW Pro personnel
  • Misuse of introductions
  • Excessive support demands
  • Attempted scraping or redistribution
  • Violation of the Single-User License
  • Reputational risk
  • Misrepresentation

We may:

  • Block platform access
  • Remove your agency from directories
  • Remove introduction eligibility
  • Ban future purchases

We are not required to disclose the reason.

No Duty to Continue Relationships

We retain sole discretion over whether, when, and how we facilitate introductions, feature agencies, or provide visibility. Past actions create no obligation for future action.
9. Disclaimers

NBW Pro does not guarantee:

  • Revenue
  • Leads
  • Proposals
  • Opportunities
  • Closed deals
  • Additional introductions
  • Meeting outcomes

We do not guarantee the accuracy of:

  • Buying signals
  • RFPs
  • Third-party data
  • Opportunity suitability

Strategic coaching does not constitute legal, financial, hiring, or business advice.
You are solely responsible for decisions made based on NBW Pro content.

Third-Party Platform Disclaimer

We are not responsible for failures or delays caused by:

  • Email providers
  • Spam filtering
  • Hosting platforms
  • Payment processors
  • Google Drive or storage tools
  • LinkedIn or social platforms
  • Any third-party system used to deliver the Service
10. Indemnification
You agree to indemnify, defend, and hold harmless NBW Pro from any claims, damages, losses, or disputes arising from:
  • Your conduct in meetings or outreach
  • Your use of introductions
  • Your decisions based on NBW Pro insights
  • Misuse of content
  • Violations of these Terms
11. Data Privacy & Security

We collect minimal data necessary to operate the Service.
We do not sell or share your personal data without consent.
We may store intro-related records.
We may retain data after cancellation for legal and operational purposes.
You may request deletion of personal data when legally permitted.

12. Force Majeure

We are not responsible for delays or failures caused by events outside our control, including natural disasters, illness, outages, data failures, or third-party disruptions. These do not entitle you to refunds.

13. Modifications to the Service

We may modify, add, or remove features at any time, including:

  • Content type or frequency
  • Directory visibility
  • Platform features
  • Future introduction structures


Changes to future introduction structures do not affect any Guaranteed Introduction owed during the Subscriber’s current prepaid term.
No refunds will be issued due to feature changes.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID DURING YOUR CURRENT SUBSCRIPTION PERIOD.

15. Governing Law, Arbitration & Class Action Waiver

These Terms are governed by Illinois law (Cook County).

All disputes must be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Either party may bring an individual claim in small-claims court.

You waive the right to:

  • Jury trials
  • Class actions
  • Collective actions
  • Representative actions
 

All claims must be brought individually.

16. Updates to Terms

We may update these Terms at any time. Continued use of the Service means you accept the updated Terms.

17. Survival

Ownership, disclaimers, indemnification, limitation of liability, governing law, arbitration, and class action waiver survive termination.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. The invalid term will be replaced with a valid term that most closely reflects the original intent.
